NewFlux.com is a traffic exchange that provides members with the opportunity to earn money back for viewing other members' web pages. You do not have to pay anything to join NewFlux.

1. ELIGIBILITY

1.a You must be eighteen or over to register as a member of or use this site. Membership is void where prohibited. By using and/or viewing this site, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all of the terms and conditions of this agreement and that you are at least 18-years old (21-years old in AL, MS, NE, WY, and any other location where 18 is not the age of majority).

2. ACCOUNT TERMS

2.a In order to use the services of NewFlux, you MUST register using your REAL first and last name and full contact information. Providing false names, incomplete names or using nicknames will result in account suspension. Your name is never shown to the public, only your User ID Number.

2.b We require that all members have at least one website added into the rotator. NewFlux is a traffic exchange, and our main product/service is website traffic and advertising. The fact that you receive cash back is a benefit of becoming a member and advertising your site(s). If you do not have a website of your own to promote, you could sign up for an affiliate program/site, or promote the site of a friend or family member.

2.c By joining, you agree to receive news, updates and advertising via email from NewFlux. NewFlux is an advertising site, and our product is advertising which includes email ads. You will not be spammed. All paid email ads are sent directly from us, and not ever any third party. You will not receive more than 2 emails in any given day. Your personal information will not be shared with others.

2.d You agree to indemnify the operators and members of NewFlux.com from all claims and harm resulting from your use of this service. In particular, you agree not to attempt fraudulent payments, not to attempt to charge-back or cancel payments for your advertising purchase. This constitutes fraud and will be prosecuted. You accept that NewFlux.com rulings on any disputes are final.

2.e NewFlux is free to join, and you do not have to pay anything in order to be able to earn here. Should you decide to increase your Ad Level, The money you pay to increase your Ad Level is a non-refundable advertising purchase, NOT an "investment", "member fee" or "deposit". By increasing your Ad Level, you are:

1. Allowed to advertise more URLS
2. Receive additional credits with each upgrade purchase.
3. Receive additional advertising packages as noted in member area for upgrade specials.

2.f Money paid to you by NewFlux.com is earned by you for your use of the services and is not "interest, dividends or other such nonsense". You are being paid for the service you provide, which is viewing our advertisers websites.

2.g The services provided by NewFlux.com are "as is" and may be discontinued at any time. NewFlux.com cannot be held responsible for events outside of our control, such as computer or network failure.

ACCOUNT INFO:

• Minimum Member Level Upgrade: $10

• Minimum surfing to earn cash: Upgraded members - Autosurf 70 sites or manual surf 40 or more in one day, Free members Autosurf 100 or manual surf 50, excluding bonus, referral and purchased credits
• Max number of credits earned per day allowed. Limit is based on account level
• 1:1 Surf Ratio - which means one credit per site surfed
• 10:8 Surf Ratio (Free Members)
• Daily Earnings for Auto Surfing: 1% of your current Member Level
• Daily Earnings for Manual Surfing: 1.25% of your current Member Level
• Life of each Upgrade Payment: 200 days

3. Surfing Requirements

3.a Our surf requirements are simple: The more you increase your Ad Level, means you are earning more and the higher your earnings, the higher the surf requirements. $10 account levels surf 50 auto and 30 manual, while $5000 account levels surf 130 auto and 70 manual.

4. Earnings

4.a NewFLux is not an Investment Opportunity. Members may buy additional Ad Units in order to take advantage and get extra benefits out of an increased Ad Level. Such payments can not be refunded after a period of 5 days.

4.b There is NO GUARANTEE of earnings, and if necessary, earnings may be reduced at times of slow sales. Sales means banner ads, text ads, email ads, credits purchases or any other product/service that we offer for sale. Membership upgrades do not constitute sales and are not used to pay out members. Ad Level purchases are used to:

1. Further promote and generate sales of our advertising services.
2. A portion is Invested in proven funds that have a history of high profits. These profits feed our reserve fund which may be used in times of slow growth.

4.c To receive commission, your referrals must use the link found on the Referral page of your account and ensure that your Referral ID is entered on the sign up form. To receive referral commission, your own account must have "Upgraded" status (not "Free") and your member level must not be zero at the time your direct referral pays to upgrade their account. No commission is payable on bonus upgrades or on payments made from your account to your referrals.

5. DOWNTIME COMPENSATION NewFlux is not responsible for disruptions to service by events that are out of our control.

6. SPAM

6.a You are encouraged to promote NewFlux.com but making false representations, using any form of SPAM or UCE including bulk email or posting to forums, lists or newsgroups etc where this type of posting is not welcome, will result in your account being cancelled, all payments and earnings will be lost, and you will be subject to prosecution.

Members are not allowed to send e-mails promoting any other programs to their referrals or referrers. All members will be seeing each others promotions when surfing.

Where To Report Spammers?
If you have been spammed by one of our members, please report it to abuse@newflux.com and immediate action will be taken. Please include the spam email, and also the member's referral link if known.

7. CONDUCT

7.a Use any of the support, help, or contact forms to threaten, defame, harass, or intimidate NewFlux, or any related parties will not be tolerated. Offender's account will be terminated, and proper authorities notified. If you post any comments, written, or otherwise which are in anyway defamatory against NewFlux or any related parties, your account will be terminated.

8. SITE TERMS

8.a To ensure the smooth operation of this service for all users, it is required that you and each site that you promote with the service must comply with the following:

• No code to break out of our surf bar frame
• No PTP Sites
• No pop-ups, pop-ins, redirects, rotators, messages, scripts, downloads, errors, dialog boxes, malicious code or anything which could interrupt our automatic page rotation
• No adult or porn sites
• No broken, under-construction or slow-loading pages
• No Hate or Discriminatory Sites
• No URL Spamming. Only one listing per URL is allowed
• You can not enter your own NewFlux Referral URL, or any NewFlux URL.

8.b Non-complying sites will be suspended or deleted and all credits and earnings lost, without notice. Repeat offenses will result in account suspension.

8.c NewFlux can not be held responsible for the content of other websites. We recommend you keep your antivirus software up to date and use a firewall.

9. ACCOUNT SUSPENSION / DELETION
9.a Your account will be deleted if it is inactive for 60 days.

9.b Repeated Bounced email is a cause for account suspension.

9.c Suspensions will be handled in the following manner:

1. Free Members who violate the terms (after 1 warning) will have their account suspended for 2 weeks.
2. Paid Members who violate the terms (after 1 warning) will have their account suspended for 1 week.

If you wish to have the suspension lifted and continue surfing, you can pay a $5 fine. This can be paid through E-gold or Maximumwallet.

10. WITHDRAWAL INFO

1. Your daily earnings are transferred to your account balance on the 1st of every month. Once in your account balance, you can Withdraw as long as you have a minimum $10.00 in your account balance.
2. Payout Methods: E-Gold.com, MaximumWallet.com only. You can only receive payout to the processor that you have made upgrades with, so if you have not upgraded with E-gold, you can not receive payout to E-gold, etc.
3. In order to receive payout, you must have your complete contact info in your profile. No Exceptions. This is the law. It is illegal for us to pay you anonymously and we will not risk our business for this. We must comply with the world laws on money laundering.
4. Withdrawals/Payouts will be made to your payment processor within 7 business days.

11.a NewFlux owns and retains other proprietary rights in the NewFlux site. The site contains the copyrighted material, trademarks, and other proprietary information of NewFlux, and its licensors. Except for that information which is in the public domain or for which you have been given permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

12. PRIVACY

12.a Any information collected on individuals participating in the NewFlux program is not sold or given to anyone, for any reason whatsoever.

12.b No credit card information is stored on the NewFlux server. All financial transactions are conducted through our merchants: who at this time are: E-Gold.com, MaximumWallet.com.

You agree not to participate if you believe programs such as NewFlux Autosurf are illegal in your area.
